Miguna return in limbo as Court refuses to lift red alerts

The High court has declined to lift the red alerts issued by the Kenyan government preventing self declared NRM leader Miguna Miguna to travel to the country. Judge Hedwig Ong'undi said there was no evidence showing that Miguna had been stopped from returning to the country. He noted that the burden of proof was on Miguna to show that the red alerts exist "There is no evidence to prove the alerts exist. This court cannot rule on speculation to grant the orders he is seeking. Case dismissed," Justice Hedwig said. "Court being a Court of law expected him to adduce evidence to prove existence of the red alerts." Under a certificate of urgency, Miguna said the alerts had prevented Lufthansa and Air France airlines from allowing him to board its planes for purposes of travel...

This is after the court dismissed Mutua’s pleas to have the case transferred to Machakos where he claimed the dispute arose. However, the court dismissed his objections ruling that the matter will be heard in Nairobi. Mutua had argued that the Nairobi court lacked territorial jurisdiction to hear and determine the case on the basis that the dispute arose within Machakos County. The court also dismissed the county boss argument that it lacked jurisdiction to hear the case filed by Nganga on the basis of the value of the shares and stocks in question. Mutua had also claimed that the issues raised by Nganga in the case were resjudicata arguin...

VCs fight Magoha plan to control varsities

Vice chancellors of public universities have disputed plans to amend sections of the University Act to give the Education CS control over the institutions. The University Act is the supreme authority guiding governance of the institutions. Among proposals fronted include the review of the powers to the university council. The councils are the main decision-making organs in the universities. Magoha argues that by the fact that the councils enjoy and exercise delegated authority from the Cabinet Secretary, he should reserve the right to review or vacate a council decision. “As the designated appointing authority, the Cabinet Secretary shall have power to revoke any appointment to, or transfer or otherwise deploy the chairperson or any member of any Council,” the proposal by ...
