Mutyambai son to face charges over fatal accident

A son to Inspector General of Police Hilary Mutyambai is likely to be charged with two counts of causing death by dangerous driving following an accident that occurred Thursday in Nairobi.

David Mwendwa Mutyambai was driving the four wheel drive car that was involved in the accident.

Mwendwa is also likely to be charged with causing serious injuries to a pedestrian following the accident.

He is out on Sh20,000 cash bail as police investigate the incident along Southern Bypass in Nairobi.

The file on the accident is likely to be sent to the Office of the Director of Public Prosecution with the recommendations.

Police are also likely to ask the ODPP to open an inquest into the accident based on the accounts of Mwendwa and passengers who were on board the double cabin car.

The accident involved the car, a pedestrian and a motorcyclist and his pillion.

At least five witnesses have recorded a statement with the police over the accident that has sparked speculations.

Mwendwa told police he was driving on the Bypass at a relatively high speed at about 6pm when he saw a motorcyclist make a u-turn ahead of him.

As he swerved to avoid hitting the motorcyclist his car hit a pedestrian who was also crossing the road.

The pedestrian is in hospital with a broken rib.

And in the process, he lost control of the car which flew over a barrier and landed on the right side of the dual carriage road hitting a motorcyclist and his pillion who died on the spot.

The car was badly damaged and Mwendwa and at least two passengers who were on board were slightly injured.

He said he feared being beaten up by other motorcyclists at the scene and fled for his safety.

The car had a third party insurance cover.

Police said their investigations into the accident are almost complete and what they are waiting for is the postmortem report of the two and a P3 form of the injured victim.

The autopsy on the two bodies is likely to be conducted on Monday December 6.

But the officers have to wait for the P3 report given the injured pedestrian is in hospital.

Nairobi County traffic boss Joshua Omukata refuted claims that the police were covering up the accident to exonerate Mwendwa, saying investigations will be conducted without putting into consideration the suspect’s relatives.

“Even if he is the son of the IG, the thing ahead of us is an accident. We are not investigating the son of the IG we are investigating the accident. It is not about other personalities,” he said

Mwendwa presented himself at Lang’ata Police Station on Friday evening, a day after the accident took place and was questioned before being released on Sh20,000 bail pending prosecution.

Omukata said the police did not find the driver at the scene.

He said officers who responded to the crash towed the vehicle to the police station and dropped the bodies of the victims at Nairobi’s City Mortuary.

Omukata said no one is interfering with the probe into the accident.

“This is an accident, a senior officer that they are referring to, is absolutely not directly or indirectly interfering with any process of investigation of this case. That is quite a separate issue, and we are treating this as a normal accident,” Omukata said.
