Primary school teacher who defiled class six pupil sentenced to serve 20 years in jail

A 45-year-old primary school teacher who defiled a 13-year-old pupil in 2016 was on Wednesday sentenced to serve 20 years in jail.

Fredrick Mwangi was sentenced by Milimani senior principal magistrate David Ndungi after the court found him guilty of the offence.

The magistrate said the prosecution had proved its case against him.

While passing the sentencing, the magistrate jailed the teacher with the sentence saying it is the minimum sentence for such an offence as provided by the law.

“The accused who is a teacher defiled a child. The rights of his children are not superior to that of the child he defiled, I hereby sentence him to 20 years in prison as provided by law,” ruled the magistrate. 

Mwangi was accused of defiling the minor who was a class six student whom he had accommodated in his house in March 2016 at Mathare North in Nairobi.

The court heard that the father of the complainant who was too drunk left her under the care of Mwangi who is a married man with two children for half a year.

The guardian of the child who is a police officer took her from Mwangi to Central Police Station.

“She was taken to two different schools but always abandoned and went back to the house of Mwangi where it was not established what she liked there,” the court was told.

On October 13, 2016, when she never reported to school she took her clothes and went back to the house of Mwangi where she found their daughter in the house since Mwangi and his wife had already gone to school.

When they came back in the evening they found her in the house wearing her school uniform.

The guardian to the child called the accused who confirmed that the girl was in his house.

He told him to escort her to the house of the guardian at Central police station which he did in the company of his wife.

The child was later interrogated by gender and children desk officers on whether there was any relationship between her and the accused or any other person in Mathare since she always left school to go to the accused house but she denied it.

On October 15, 2016, police escorted the complainant to the hospital for a checkup and underwent counselling.

She opened up and stated that Mwangi used to sexually violate her since she started living with him in his house and used to threaten her not to reveal it.
